Buyer's Realtor:
a licensed professional who represents the prospective BUYER (purchaser) exclusively. As a Buyer's Consultant, the Realtor owes the BUYER the common-law and statutory agency duties and has responsibility to the BUYER to give their best effort to the Buyer and to get the Buyer the best possible price and terms.
I serve only the Buyer, but my fee is paid by the Seller.
I accept the normal Commission split offered through MLS, so the seller pays my fee.
Listing Realtor:
a licensed professional who represents the SELLER.
As the Listing Realtor, the Realtor owes the SELLER the common-law and statutory agency duties and has fiduciary responsibility to the SELLER.
A Listing Realtor works for the Seller and that means getting the best deal possible for the Seller, NOT you, the Buyer. So when that listing agent shows you his/her property, who's protecting YOU?
ATTORNEYS DO NOT REPRESENT BOTH SIDES, NEITHER SHOULD REALTORS!
A lawyer can no more represent the defendant and plaintiff in a lawsuit than can a Realtor effectively represent both the buyer and seller in real estate negotiations and transactions.
